Welcome to myblueboard®. The (https://myblueboard.com) website and all associated webpages are furnished by myblueboard, LLC. (“myblueboard®”, “we”, or “us”) and is intended to provide an all-in-one platform for managing educational and community groups and programs. myblueboard® is designed to help educators, students, parents, volunteers, and other users manage, communicate, organize, fundraise, and participate in various platform-related activities. In addition to the myblueboard® Site, myblueboard® makes available other products, services and applications through and in conjunction with the myblueboard® Site (collectively, “Services”). These Terms and Conditions are an agreement between myblueboard, LLC and any and every user of the myblueboard® Site and/or Services (“you”, “your”, etc.). The Terms and Conditions govern your access to, and use of, the myblueboard® Site and Services.

By clicking on the “I Agree” checkbox or by accessing, browsing, or otherwise using the myblueboard® Site or Services, you agree to be bound by these Terms and Conditions, including any subsequent changes or modifications to them, which together with our Privacy Policy govern the relationship between myblueboard® and all users of the myblueboard® Site and Services. If you do not agree to these Terms and Conditions or any changes, do not access or otherwise continue to use the myblueboard® Site and Services. Your right to access the myblueboard® Site and Services terminates immediately upon any breach of these Terms and Conditions.

Intended Purpose

The myblueboard® Site and Services are intended to be used by subscribing organizations (“Subscriber(s)”) to assist in the management of fine arts programs and other multi-member programs (“Programs”) by facilitating communication by and between those organizing and managing the Programs (“Program Administrator(s)”), staff and personnel associated with the Programs (“Staff”) and the members of the various Programs (“Members”) to manage the schedules, equipment and other items used by Members and Staff of the Programs. This is the “Intended Purpose” of the myblueboard® Site and Services. The Intended Purpose does not include the storage, use or sale of information outside the myblueboard® Site. Information made available to you through your use of the myblueboard® Site and Services is for use solely for the Intended Purpose.

Authorized Access to myblueboard® Sites and Services

You represent and warrant to myblueboard® that you are authorized under these Terms and Conditions to access the Site and Services. You further represent and warrant that:

  • If you are accessing the myblueboard® Site or Services on behalf of a Subscriber or Program, you have the authority to agree to these Terms and Conditions on their behalf and to bind that Subscriber or Program to these Terms (in which case, “you” and “your” refer to the Subscriber or Program, except in this sentence).
  • You are legally permitted to use and access the myblueboard® Site and Services and take full responsibility for that use—including:
  • Communicating with others through the platform,
  • Granting access to other Program Administrators or Staff, if you are acting for a Subscriber,
  • Granting access to Members, if you are acting as a Program Administrator.
  • All registration information you provide will be accurate and truthful, and you agree to keep it up to date.

Access and Roles

  • Program Administrators—whether school staff, program leaders, or authorized parent volunteers—may access and use the myblueboard® Site and Services to set up and manage their Program.
  • Staff (such as coaches, teachers, or additional volunteers) and Members (such as students or participants) may access and use the platform if authorized or invited by a Subscriber or Program Administrator.
  • If you are accessing the Site or Services as Staff or a Member, you represent and warrant that:
  • You are authorized to do so,
  • You will comply with these Terms and Conditions,
  • You are legally permitted to access and use the platform and, if required, have obtained parental or guardian consent,
  • All information you provide will be accurate and kept current.

Scope of Access

Subscribers, Program Administrators, Staff, and Members may only access the parts of the myblueboard® Site and Services that are specifically made available to them. Any unauthorized access or attempted access is strictly prohibited and may result in suspension, legal liability, or both.

Acceptable Use and Conduct

The myblueboard® Site and Services may be used only for their intended purpose: to support the administration, communication, and fundraising needs of your program. All other uses are strictly prohibited.

You agree to use the Site and Services only for lawful purposes. You may not transmit, store, or present any content or information that violates any applicable law, rule, or regulation. In the event of any conflict between these Terms and applicable laws or regulations, the latter shall take precedence.

You may not impersonate any person or entity, use a false name, or use another person’s login credentials. We reserve the right to revoke or cancel any login credentials at our sole discretion, without notice—especially if we believe they have been misused or compromised.

If you are a Member, your profile (including name and profile image, if uploaded) may be visible to Subscribers, Program Administrators, Staff, and other Members associated with your Program.

Any information you provide (such as your name, email address, or other identifying details) will be collected and used in accordance with these Terms, our Privacy Policy, and any applicable agreements made by your Program or Subscriber.

You agree not to upload, post, or share any content through the Site or Services that:

  • Infringes on someone else’s intellectual property (such as copyrights or trademarks),
  • Is unlawful, abusive, defamatory, threatening, harassing, vulgar, obscene, or otherwise objectionable,
  • Violates someone’s privacy or publicity rights, or
  • Could disrupt the Services (such as viruses, denial-of-service attacks, or similar harmful content).

We reserve the right—but not the obligation—to monitor, edit, or remove content at our sole discretion if it is found to be offensive, harmful, unlawful, or otherwise inappropriate.

Spam or unsolicited email is strictly prohibited when sent through our system or using any email address/domain hosted by myblueboard®. Likewise, framing, mirroring, scraping, or data-mining of any part of the Site or Services is not allowed.

Use By Minors and Responsibility of Adults

Minors under the age of 18 may not act as Program Administrators.

If you register a user profile on behalf of a minor or allow a minor to access the Site using your account:

  • You are fully responsible for that minor’s conduct and use of the Services,
  • You must monitor and manage their access, and
  • You are accountable for any misuse.

For users under age 13, we may require verifiable consent from a parent or legal guardian before the minor can access the myblueboard® Site and Services. Upon request and in accordance with applicable law, myblueboard® will grant parents, guardians, or other authorized adults access to the minor’s account.

Protection of Member Information

Ownership of Content and Intellectual Property

The myblueboard® Site and Services, along with all related materials—including our name, branding, products, pricing, services, promotional programs, advertisements, trademarks, audio and video, images, articles, surveys, applications, and other content (collectively, “Content”)—are the property of myblueboard® and are protected by U.S. and international copyright, trademark, and other applicable laws.

This includes the overall design, layout, coordination, appearance, and arrangement of the Site and Services, which are protected as a collective work. We either own or are licensed to use all components of the Content.

You may not copy, reproduce, modify, upload, publish, post, transmit, distribute, decompile, reverse engineer, or disassemble any part of the Content, unless it is:

  • For your own permitted use of the Site and Services, and
  • Necessary to fulfill the Site’s Intended Purpose (i.e., managing or participating in your Program).

Your access to the Site does not give you any ownership or license rights in our Content or any of our intellectual property. Nothing on the Site should be interpreted as granting you permission—express or implied—to use any of our patents, trademarks, copyrights, trade secrets, or other proprietary materials without written consent.

Unauthorized use or modification of our Content—especially on other websites or platforms—is strictly prohibited and may violate intellectual property laws as well as privacy, publicity, and communications regulations.

We reserve the right to enforce our intellectual property rights to the fullest extent of the law, including pursuing damages, legal fees, and criminal prosecution when applicable.

Feedback

We may offer ways for you to share feedback, ideas, testimonials, or suggestions (“Feedback”) about the myblueboard® Site and Services. If you choose to share Feedback with us, you agree:

  • You give up any rights to that Feedback; all rights become the property of myblueboard®, including any intellectual property rights.
  • You assign all rights to us permanently and irrevocably.
  • You confirm that the Feedback is your original work and that you have the right to share it.
  • You grant myblueboard® the unlimited, perpetual right to use, modify, redistribute, and create derivative works from your Feedback for any purpose, in any media, without compensation.
  • You waive any “moral rights” (such as the right to be credited or to object to changes in the work).

Publicity

myblueboard® will not publicly share the name of your Program, School, or School District without your prior consent.

With permission, we may include your Program’s name in a list of customers, on our website, in promotional materials, or as part of a case study or testimonial. Any such use will be approved in writing by the Subscriber or an authorized Program Administrator beforehand.

We respect the privacy of our users and will never reference your Program without permission.

Your Responsibility and Liability

You are responsible for your actions and content while using the myblueboard® Site and Services. This includes any content:

  • You submit,
  • That someone else submits using your login or account, or
  • That you post on our social media pages.

You agree to indemnify and hold harmless myblueboard®, its team, affiliates, and representatives from any claims, damages, losses, or costs—including legal fees—arising from:

  • Violations of law or regulation through your use of the Services,
  • Breaches of any terms, representations, or warranties in this agreement, and
  • Intellectual property violations related to the content you or someone using your account submits.

Additional Terms for All Users

These Terms apply to all users of the myblueboard® Site and Services, including:

  • Subscribers (those who set up the account and pay for Services),
  • Program Administrators (staff or volunteers with administrative access),
  • Staff (teachers, coaches, parent helpers, etc.),
  • Members (students, participants, or other invited users).

If you’re joining a Program as a student, parent, or volunteer, you’re considered a Member.
If you’ve been given admin access to manage the Program, you’re a
Program Administrator.
If you’re agreeing on behalf of a school, team, club, or organization, you’re acting as a
Subscriber.

If You Are a Program (e.g., School, Club, District, or Team)

As a Program (such as a school, school district, club, community group, or team), you are responsible for keeping your Program’s information accurate and up to date.

If you become aware that someone is using the myblueboard® Site and Services while claiming to be affiliated with your Program but is not, you agree to:

If you are acknowledged by myblueboard® as a Program Administrator, you may be able to:

  • Invite and add other Program Administrators and Members,
  • View and manage users and information tied to your Program,
  • Add, remove, or update Program Administrators and Members,
  • Upload or sync data about your Program, Members, groups, or classes (for example, using CSV files or integration with your Student Information System),
  • Join or create classes and groups for your Program,
  • Communicate with Members affiliated with your Program,
  • Access Member submissions and Program-related information, and
  • View contact details and personally identifiable information (PII) of Members connected with your Program, and track which users have received communications from your Program.


Important: If you choose to perform any of the actions above, you represent and warrant that:

  • You have all necessary rights, consents, and authorizations to do so,
  • You will only use personal information in compliance with applicable privacy laws.

myblueboard® may use the information you upload to help verify Program and Member affiliations and to deliver the Services to your Program.

Fees, Payments, Discounts, and Late Charges

Subscribers agree to pay the fees for access and use of the myblueboard® Site and Services as outlined in their invoice, purchase order, online payment, or custom quote.

  • Unless otherwise stated, all payments are due within 30 days of the invoice date.
  • Any offered discounts are valid for 60 days from the original invoice date, unless otherwise specified.

If a payment becomes overdue:

  • myblueboard® may charge interest of 1.5% per month (or the maximum allowed by law, if lower) until payment is received.
  • The Subscriber is responsible for any reasonable costs related to collection efforts, including legal fees.
  • myblueboard® reserves the right to disable account access until outstanding payments are resolved.

Custom or out-of-scope services (such as manual data imports or setup assistance beyond standard support) may be subject to an additional hourly fee. These fees will always be clearly communicated in advance and require your approval before work begins.

Free Trial

myblueboard® offers new users a free 7-day trial to explore the full platform.

What’s included:

  • Access to all standard features and tools during the trial period (unless otherwise specified).

Terms:

  • The trial is for new customers only and limited to one trial per organization.
  • No payment information is required to start the trial.
  • After 7 days, access will automatically expire unless a paid subscription is activated.
  • Any data entered during the trial may be retained for a short period (according to our data policies), but may be permanently deleted unless otherwise requested.
  • You may upgrade to a paid plan at any time during or after the trial.
  • myblueboard® reserves the right to revoke trial access in cases of suspected misuse or abuse.

By signing up for a free trial, you agree to these Terms and Conditions.

Transaction Fees and Payment Processing

When you use myblueboard’s online shop or payment features, the following fees apply:

  • All transactions are subject to standard third-party payment processing fees (e.g., Stripe or PayPal), plus a 1% platform fee from myblueboard®.
  • The combined total usually ranges between 4–5% per transaction.
  • These fees are automatically applied at checkout and included in the final transaction total.

Links to Third-Party Sites and Content

The myblueboard® Site and Services may contain links to third-party websites, platforms, or content. These are provided solely for your convenience.

  • myblueboard® does not control or endorse any third-party sites or content.
  • We make no warranties or representations about the quality, reliability, or safety of any linked site or its content.
  • Inclusion of a link does not imply affiliation or endorsement by myblueboard®.

Once you leave the myblueboard® Site and Services, these Terms and Conditions no longer apply. We recommend reviewing the privacy policies and terms of any third-party sites you visit.

Security and Data Privacy

myblueboard® is built with the highest standards of security in mind. We are committed to protecting your data and maintaining your trust.

  • Our platform is hosted on industry-leading cloud infrastructure (AWS), ensuring best-in-class reliability, resiliency, and security.
  • All data in transit is protected using advanced encryption protocols to keep your information secure at all times.
  • We do not sell, share, or mine user data in any way.
  • myblueboard® complies with all applicable state-level data protection regulations and maintains strict internal policies to safeguard personal and program information.

We take privacy seriously and are committed to responsible data stewardship across all aspects of our platform.

Disclaimers of Warranties

Although we implement industry-leading security measures, we cannot guarantee absolute security. Use of the Site and Services is at your own risk, and subject to the disclaimers and limitations outlined in these Terms.The myblueboard® Site and Services are provided “as is” and without warranties of any kind.

To the fullest extent permitted by law:

  • myblueboard® and its employees, agents, and affiliates make no guarantees that the Services will be uninterrupted, error-free, secure, or free from viruses or harmful components.
  • We make no warranties, express or implied, about:
  • The accuracy, completeness, or reliability of the information provided;
  • The quality or fitness of our platform for any particular purpose;
  • Non-infringement of third-party rights.

You use the Site and Services at your own risk.

Limitation of Liability

To the extent permitted by law, myblueboard® and its affiliates are not liable for any:

  • Indirect, incidental, special, or consequential damages;
  • Loss of profits, data, business opportunities, or intangible losses.

This includes damages resulting from:

  • Your use of (or inability to use) the platform;
  • Errors or inaccuracies in content;
  • Technical issues or service interruptions;
  • Issues related to third-party content or links.

Our total liability, for any claim related to these Terms or your use of the Services, will not exceed the amount you paid to myblueboard® in the twelve (12) months prior to the event giving rise to the claim.


Exceptions: This limitation does not apply in cases of gross negligence, intentional misconduct, or violations of applicable law.

Technology and Display

  • myblueboard® is not responsible for any damage to your device, loss of data, or technical issues resulting from your use of the Site and Services.
  • You are solely responsible for the cost of any repairs, servicing, or data restoration needed due to use of our platform.
  • We make efforts to accurately display product images, colors, and proportions on the Site, but actual appearance may vary depending on your device settings or screen.

Governing Law

These Terms and any transactions related to the Services will be governed by and interpreted in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. All Services are considered to be performed entirely within the State of Ohio.

No Injunctive Relief by Users

You agree that you will not seek or be entitled to injunctive, equitable, or other relief that would in any way interfere with or restrict the operation of the myblueboard® Site or Services.

Arbitration Agreement

If a dispute arises and cannot be resolved through mutual agreement, both parties agree to resolve it through binding arbitration.

  • Location: Unless otherwise agreed, arbitration will take place in Columbus, Ohio, before a single mutually agreed-upon arbitrator. If one cannot be agreed upon, an arbitrator will be appointed according to myblueboard LLC’s established rules.
  • Timeline:
  • Arbitration must begin within 45 days of a written demand.
  • The decision will be delivered within 60 days of the conclusion of the arbitration and no later than 6 months from arbitrator selection.
  • Limits on Damages:
  • The arbitrator may not award any damages beyond what is allowed by these Terms.
  • The arbitrator may not issue punitive damages or multiply actual damages.
  • Legal Costs: The arbitrator may assign legal costs and fees to either party at their discretion. A party refusing to comply with the arbitrator’s order may be responsible for the other party’s legal costs in enforcement.


myblueboard® may bypass arbitration to seek temporary injunctive relief in court if necessary to avoid immediate and irreparable harm.


By agreeing to arbitration, you understand that:

  • You are waiving your right to go to court.
  • You are waiving your right to a jury trial.
  • You agree to resolve disputes individually, not as part of any class or representative action.

Jurisdiction and Venue (if arbitration doesn't apply)

If a matter is not subject to arbitration, any legal action must be filed in the state or federal courts of Franklin County, Ohio. You agree to the exclusive jurisdiction of these courts and waive any right to a jury trial.

Class Action Waiver

You agree to bring any claims only in your individual capacity.

  • No class, collective, or representative actions are permitted.
  • You waive any right to participate in a class action or similar group proceeding.
  • No arbitrator or court may combine claims or make an award to any non-party.

If any part of this class action waiver is challenged, that challenge must be decided by a court, not an arbitrator.

Waiver and Severability

  • If myblueboard® chooses not to enforce a right under these Terms, it does not mean we’ve waived that right in the future.
  • If any part of these Terms is found to be unenforceable, that part will be limited or removed as needed, and the rest of the Terms will remain in effect.


Some rights and limitations in these Terms may not apply in jurisdictions where they are prohibited by law. You may have additional rights depending on your location.

Termination for Breach

myblueboard® may suspend or terminate your access to the Site and Services at any time if:

  • You violate these Terms and Conditions,
  • You provide false, incomplete, or misleading information,
  • You infringe upon myblueboard®’s proprietary rights, or
  • For any reason we deem necessary, or for no reason at all.

We reserve this right to protect the integrity of our platform and community.

Website Monitoring and Tracking

We reserve the right to electronically monitor the myblueboard® Site and Services as permitted or required by law.

This may include access to or disclosure of information to:

  • Operate our systems properly,
  • Comply with legal requests or regulations,
  • Protect our business or users, or
  • Fulfill any legitimate purpose we determine in good faith to be necessary.

DMCA Notice – Copyright Infringement Policy

We respect the intellectual property rights of others and comply with the Digital Millennium Copyright Act (DMCA).

Third-party content (such as uploaded materials or items sold in your shop) may appear on the platform, and we do not pre-screen such content for copyright compliance. However, we do not knowingly allow infringing materials to remain accessible.

If you believe that any content on the myblueboard® Site infringes your copyright, please send a written notice including all of the following:

  1. A physical or electronic signature of the copyright owner or authorized representative,
  2. Identification of the copyrighted work you believe has been infringed (include a URL or copy, if available),
  3. A description of the material you claim is infringing, and information sufficient to locate it on our site,
  4. Your full name, address, phone number, and email (if available),
  5. A statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law, and
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.

Trademarks

All logos, product names, and brand elements displayed on the myblueboard® Site and Services are the property of myblueboard® unless otherwise noted.

You may not display, reproduce, or use our trademarks—including logos or design elements—without our prior written consent.

Advertising and Promotional Communications

By accepting these Terms and Conditions, you agree to receive marketing and promotional communications from myblueboard®, which may include emails or other forms of electronic messaging about our products and services.

If you prefer not to receive marketing emails, you may opt out at any time by contacting support@myblueboard.com. This will not affect service-related communications.

Termination of Access and Repeat Infringer Policy

We may suspend or terminate your account or access to the myblueboard® Site and Services, at any time and for any reason, including—but not limited to:

  • Violations of these Terms,
  • Repeated copyright infringement (as determined under our DMCA policy),
  • Abuse of the platform, or
  • At our sole discretion, with or without notice.

Termination includes deactivation of your account and denial of future access to the Services.

Public Records and Compliance with Ohio Senate Bill 29

myblueboard® complies with all applicable public records laws, including Ohio Senate Bill 29.

If a public records request is received:

  • We will respond promptly and during regular business hours.
  • A designated records officer will prepare and provide email and message-based records within a reasonable time.
  • Non-exempt information will be disclosed; redactions will be clearly noted.
  • We may deny overly vague or broad requests, but we will provide guidance on how to revise them.

Request Limits:

  • By default, we may limit deliveries to ten records per month per requester—unless the requester provides a written certification that the request is not for commercial purposes.
  • “Commercial” use does not include journalism, citizen oversight, or nonprofit educational research.

Other Public Records Practices:

  • We will not require requesters to disclose identity or intended use unless required by law.
  • We may request written confirmation or payment for physical delivery or format conversions.
  • The sharable calendar or schedule remains the property of the program director/administrator and is not considered public record.

Educational Records and Data Protection

Educational records created, received, or maintained by myblueboard® on behalf of a school district are the sole property of the district.

  • We do not use educational records for marketing, advertising, or commercial purposes.
  • We do not mine, sell, or share user data for commercial purposes.
    However, we may use aggregated, anonymized data—which contains no personally identifiable information—for the sole purpose of improving, supporting, and maintaining the platform.

Security and Access:

  • Access to educational records is restricted to staff or contractors with a direct need to fulfill their work duties.
  • We maintain appropriate technical and organizational safeguards to protect student data.

Breach Notification:
In the event of a data breach, myblueboard® will promptly notify the affected school or district and provide the necessary information to respond effectively.

End-of-Contract Data Handling:
Unless contract renewal is reasonably expected, educational records will be destroyed within 90 days of contract termination.

Device Monitoring:
We do not engage in electronic surveillance (e.g., keystroke logging, web activity tracking, or audiovisual recording) on school-issued devices unless:

  • Required for noncommercial educational purposes,
  • Needed for technical support,
  • Ordered via a judicial warrant,
  • Necessary to recover a stolen device, or
  • Needed to prevent or respond to a credible threat to life or safety.

Access is strictly limited to these purposes.

Changes to These Terms and Conditions

myblueboard® reserves the right to modify or update these Terms at any time, at its sole discretion.

  • If changes are made, we will post the revised Terms with an updated "last revised" date at the bottom of the page.
  • Continued use of the Site and Services after the new Terms are posted constitutes your acceptance of those changes.

We encourage you to review the Terms regularly to stay informed about your rights and responsibilities.
